1. INTRODUCTION: The 2010 Opening Day Ticket Giveaway is sponsored by Insomniac Ink, Ltd., a Wisconsin Corporation ("Insomniac Ink" or "Milwaukee Shirt Guys"), Insomniac Ink LTD, PO BOX 320204, Franklin, WI 53132

2. SWEEPSTAKES PERIOD: Entries for the 2010 Opening Day Ticket Giveaway may be submitted beginning on March 3, 2010 at 5:00 PM CST, and ending on March 29, 2010, at 5:00 PM CST (the "Promotion Period"). All entries must be received during the Promotion Period. One (1) Grand Prize winner will be selected by random drawing to be conducted on or about March 30, 2010. By participating, you agree to these Official Rules. Restrictions apply as provided below.

3. PRIZES: The Grand Prize will consist of 2 tickets to the Milwaukee Brewers baseball home opener game and 1 Parking Pass to be held on April 5, 2010.

4. PRIZE RESTRICTIONS: All taxes, fees, and insurance expenses, if any, are the sole responsibility of the winner. No prize substitution, cash substitution, assignment or transfer of the prize is permitted.

5. ELIGIBILITY: The 2010 Opening Day Ticket Giveaway is open only within the territorial United States, excluding Puerto Rico, to legal residents in the 50 states who are 18 years of age or older at the time of entry as confirmed by a valid government-issued photo identification. Employees of Insomniac Ink and the immediate families (spouses, parents, children, siblings) and household members of such employees are not eligible.

6. HOW TO ENTER: NO PURCHASE NECESSARY. Purchasing does not improve your chances of winning. You must mail your full name, mailing address, email address and phone number to: Insomniac Ink, PO BOX 320204, Franklin, WI 53132 in order to be entered into the giveaway.  Only one entry per envelope allowed.  Incomplete or illegible entries, or entries received through impermissible or illegitimate channels, are void. By entering the giveaway, you are agreeing to be notified by e-mail or telephone if you are the winner of the 2010 Opening Day Ticket Giveaway and you are further agreeing to arrange for pick up or delivery of the prize within the metro Milwaukee area on or before April 5, 2010. Proof of sending will not be deemed to be proof of receipt by 2010 Opening Day Ticket Giveaway. Up to five (5) entries per household during the Promotional Period are permitted. Duplicate entries will be voided. You may not exceed this limit by entering with different contact information. Entries are the property of Insomniac Ink and will not be returned. In the unlikely event that Insomniac Ink encounters technical or equipment failures such as computer systems failure or human error in connection with the sweepstakes, Insomniac Ink will not be held responsible.  Purchase of each full-price t-shirt (i.e. non-sale and non-closeout items) via the Milwaukee Shirt Guys online catalog (available at www.milwaukeeshirtguys.com) during the Promotional Period will automatically enter you into the giveaway, if you provide Milwaukee Shirt guys with all of the necessary contact information at the time of purchase, including full name, mailing address, email address.  The totally number of entries per household received from either the Milwaukee Shirt Guys online sales and/or mail entries may not exceed the five (5) entry limit. 

7. SELECTION OF WINNERS: Winners will be selected in a random drawing conducted by Insomniac Ink from all eligible and valid entries received. Odds of winning depend upon the number of entries received. Winners will be notified within three (3) days of the drawing by electronic mail, by telephone or by mail addressed to the home address provided on winner's entry form. In the event that Insomniac Ink is unable to reach the winner within three (3) days of the drawing, an alternate winner will be chosen.  By accepting the prizes, winners agree that Insomniac Ink, its subsidiaries, affiliates, distributors, advertising and promotional agencies and suppliers and all of their respective officers, directors, employees, representatives and agents shall have no liability for, and shall hold all such parties harmless against any claim, damage, loss or injury that may arise in whole or in part, directly or indirectly, from the acceptance, possession, use or misuse of prizes or participation in this Sweepstakes.

8. MISCELLANEOUS: This sweepstakes is subject to all applicable federal, state, provincial and local laws. Void where prohibited: you may not participate in any state or jurisdiction where this sweepstakes is prohibited by law. Insomniac Ink shall be entitled to interpret these rules as needed - including but not limited to rules regarding entries, selection of winner, deadlines, restrictions on the prize, and eligibility - and all of its decisions are final. By entering, you agree to these conditions. You agree that Insomniac Ink, and any subsidiaries and affiliates, and their consultants, agencies and employees, and any telephone network or service provider shall not be responsible for incorrect, inaccurate or incomplete transcription of entry information; for lost, stolen, late, or misdirected entries; for incorrect e-mail addresses or bounced-back e-mail messages; for destruction or alteration of entries; for unauthorized access to entries; or for any human error, technical malfunction, delay in operation or transmission, lost data, omission, interruption, deletion, defect, communications line failure, computer equipment, software, inability to access any web site or online service, or any other error or malfunction. Proof of sending an entry will not be deemed to be proof of receipt by Insomniac Ink.

9. VIOLATIONS OF RULES: Insomniac Ink reserves the right, at its sole discretion, to disqualify any individual it reasonably suspects or believes to be tampering with the entry process or the award mechanism, whether on-line or by any other means, or to be acting in violation of these rules.

10. LIMITATION ON LIABILITY: You agree that Insomniac Ink and any of its subsidiaries and affiliates, as well as any of their consultants, agents and employees, and any service provider will not be liable for any claim, injury, loss or damage of any kind (including but not limited to damage to computer equipment) resulting from participation in this sweepstakes or the acceptance or use of the prize. You further agree that Insomniac Ink and any subsidiaries and affiliates are not responsible for typographical or other errors in the offer or administration of this sweepstakes, including but not limited to errors in advertising, the Official Rules, the selection and announcement of the winner or the distribution of the prize. Insomniac Ink reserves the right to modify these rules for clarification purposes without materially affecting the terms and conditions of the sweepstakes.

11. IMPAIRMENT OF INTEGRITY OF SWEEPSTAKES: If for any reason this sweepstakes or any portion thereof is incapable of running as planned because of infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failure, strike, act of God, or any other cause beyond the control of Insomniac Ink, Insomniac Ink reserves the right, at its sole discretion and without obligation or prior notice, to cancel, terminate, modify or suspend the affected part of the sweepstakes. In such event, Insomniac Ink will conduct a drawing to award the prize using all entries received as of the time of cancellation, termination, modification or suspension.

12. WINNER'S NAME: Winners name and likeness may be posted on the Milwaukee Shirt Guys website at www.milwaukeeshirtguys.com for a minimum of 14 days, after which it may be removed.

13. BINDING ARBITRATION: By entering the drawing, the entrant agrees that any and all claims against Insomniac Ink, its affiliates, employees, officers, directors, judges and agents, arising out of this drawing shall be settled by final and binding arbitration before the American Arbitration Association in Milwaukee County, Wisconsin. Any such claim must be filed with the American Arbitration Association within one year after the date that the names of the winners have been posted, or no claim or action may be sustained against Insomniac Ink, its affiliates, employees, officers, directors, judges and agents, arising out of this drawing.

14. PRIVACY POLICY: Subject to the third sentence of this paragraph 14, you specifically acknowledge and agree that Insomniac Ink, or any of its subsidiaries or affiliates, may utilize information obtained from you in order to contact you and/or to offer their products or services or for other promotional purposes, including online announcements, and as otherwise permitted by their privacy policies. That authorization includes authorization to Insomniac Ink, or any of its subsidiaries or affiliates, to provide information about our products and services via email, postal mail, fax and telephone. Participant may opt-out of receiving such information and the authorization provided in the preceding sentences at any time, including by stating in writing your election to opt out at the time of submission of your entry. If you would like to have your name removed from future mailings by Insomniac Ink, you may notify Insomniac Ink via email at the following address: info@insomniacink.com. By accepting a prize, winner consents to the use of his or her name, photograph (including the use and appearance of winner's photograph on the web pages of Insomniac Ink (its affiliates or subsidiaries), likeness, biographical information, voice, and e-mail address in this and future promotions and publicity without further compensation, except where prohibited by law.
